These terms govern your use of the FactoryNXT website at this address. By browsing the site or submitting the demo request form, you accept them. If you do not accept them, please stop using the site.

These terms do not cover the FactoryNXT product. Use of a deployed FactoryNXT platform instance is governed by a separate written agreement between FactoryNXT and the customer organisation. Where that agreement and these terms conflict, that agreement wins.

1. Who we are

This site is operated by FactoryNXT. References to “we”, “us” and “our” mean FactoryNXT; “you” means the person using the site.

2. Permitted use

You may browse these pages, download the material we publish for your own evaluation, and submit genuine enquiries through the demo request form.

You agree not to:

• submit automated, fraudulent, or deliberately misleading enquiries, or another person's details without their knowledge;
• attempt to disrupt or overload the site, or interfere with its normal operation;
• probe, scan or test the site's security without our prior written permission, other than good-faith vulnerability research reported to us under our Security page;
• attempt to reach the internal areas of this site, including any administrative dashboard, without authorisation;
• scrape, mirror, or systematically extract the site's content; or
• use the site in any way that breaks applicable law.

3. Enquiries you submit

Submitting the form is an enquiry, not an order, and creates no contract between us. We are not obliged to respond to every enquiry. Please do not send confidential or commercially sensitive information through the form — send an enquiry first and we will arrange an appropriate channel. How we handle what you submit is set out in our Privacy Policy.

4. Intellectual property

The content, design, product screenshots, page layouts, and brand marks on this site are owned by FactoryNXT or licensed to us, and are protected by intellectual property law. You may not reproduce, republish or redistribute them without our permission. Third-party names and marks referred to on this site remain the property of their respective owners; their appearance does not imply endorsement by those owners.

5. Accuracy of what you see here

Product descriptions, dashboard imagery, metrics and case material on this site are illustrative. Figures shown in screenshots and summaries are representative examples used to explain what the product does — they are not guarantees, forecasts, or commitments about the results you will achieve.

Actual outcomes depend on your equipment, processes, data quality and deployment scope, and will be assessed during a technical evaluation. Nothing on this site forms part of any contract or constitutes advice you should act on without that evaluation.

6. Availability

We aim to keep the site available but do not guarantee uninterrupted access. We may change, suspend or withdraw any part of it, at any time, without notice. Any service levels quoted on this site describe the FactoryNXT platform under a customer agreement, not this website.

7. Third-party resources

This site loads fonts and libraries from third-party providers and may link to external sites. We do not control those services and are not responsible for their availability, content, or practices. A link is not an endorsement.

8. Disclaimer and liability

The site is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law.

To the extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill, or data, arising from your use of or inability to use this site, or from reliance on anything published on it.

Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded.

We may update these terms from time to time. The date at the top of this page shows when they were last revised. Continuing to use the site after a change means you accept the revised terms.
